1. Affidavit-of-service filed in Court today be taken on record.

2. The petitioners were and are the members of Bansberia Mill Mutual Benefit Co-operative Relief Society Limited. They are the ex-employees of Ganges Manufacturing Company Limited, which is a Jute Mill.

3. During their service they deposited money from time to time with such Society which has not been refunded or paid to them after their retirement.

4. The petitioners have complained to the Mogra Police Station in this regard.

5. In the facts and circumstances of this case, this Court directs the Mogra Police station to forthwith register an FIR, inter alia, under Sections 406 and 420 of the Indian Penal Code.

6. Pendency of the criminal proceedings should not stand in the way of proceedings being conducted by the Special Officer, namely, Smt. Madhuchanda Pal under the provisions of the West Bengal Co-operative Society Act, 2006.

7. With the aforesaid directions, the instant writ petition shall stand disposed of.

8. There will be no order as to costs.

9. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
