Learned advocate appearing for the petitioner submits that the petitioner was falsely implicated. He refers to the complaint as against the petitioner. He submits that the petitioner was not issued a notice under Section 41A of the Criminal Procedure Code.

Learned advocate appearing for the State draws the attention of the Court to the materials in the case diary. He submits that the petitioner took money from the de facto complainant with a promise for giving employment. He refers to a document signed by the petitioner. It is contended on behalf of the petitioner that the petitioner did not sign such document.

There are materials in the case diary implicating the petitioner. It appears that the petitioner obtained money

from the de facto complainant on a promise to give the de facto complaint employment.

Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.

CRM (A) 3078 of 2022 is dismissed.
