Petitioner is aggrieved by the progress of investigation of Kharagpur Town P.S. Case No.250 of 2025 dated 24.05.2025 wherein the petitioner set the criminal law into motion. The grievance of the petitioner is that in spite of police authorities having registered the case, they are reluctant to proceed with the investigation of the case. Consequently, the petitioner is suffering mental agony and anxiety. Additionally, it has been submitted that there are heinousness to the offences alleged but in spite of the same, the progress of the investigation has not been

communicated and the petitioner is in the dark as to whether the investigation is progressing in a proper direction.

Learned advocate appearing for the respondent no.6 submits that on the ground of pendency of the present writ petition, the State has been praying for accommodation at the time when the anticipatory bail is taken up for consideration in sessions court by the learned Sessions Judge. Be that as it may, since the writ petition has no connection with the issues relating to anticipatory bail, further adjournment be not granted to the petitioner on the next date fixed before the learned Sessions Judge.

Learned advocate for the respondent nos.4 and 5 submits that the respondents being accused in the aforesaid criminal case preferred an application under Section 482 of the Cr.P.C/528 of the BNSS wherein a co-ordinate Bench has been pleased to direct that no coercive steps be taken against the respondent nos.4 and 5.

Be that as it may, since the investigation has already commenced and offences involved are under Section 109 (1) as well as under Section 74 of the BNS, I direct the investigating agency to collect the relevant materials and ensure that within a

reasonable period of time the investigation of the case be taken to its logical conclusion. If the cooperation of the petitioner who has set the law into motion is required, the petitioner on being informed would cooperate and coordinate with the investigating agency.

With the aforesaid observations, WPA 12937 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Needless to state that the observation made in the aforesaid order is restricted only for disposal of the present writ petition and will not have any bearing on any other applications pending before other forums.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
