08.06.2023 sdas rejected C.R.M.(DB) No. 2179 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Balurghat Police Station Case No. 668 of 2022 dated 16.09.2022 under Sections 302/201/120B/34 of the Indian Penal Code.

And In Re : Raghu Chaki & Anr. .... petitioners Mr. Kaushik Choudhury Ms. Busra Khatun ....for the petitioners Ms. Anasuya Sinha Mr. Pinak Kumar Mitra .... for the State Learned Counsel for the petitioners submits co-accused have been enlarged on bail. They pray for bail. Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Statements of witnesses recorded under Sections 161 and 164 of the Code of Criminal Procedure ascribe principal role to the petitioners and one Mahadeb Chowdhury @ Bittu in the murder. Bail prayer of Mahadeb Chowdhury @ Bittu has been turned down by this Court. Under such circumstances and in view of gravity of the offence, we are not inclined to grant bail to the petitioners. The application for bail is, thus, rejected.
