The petitioner has filed the instant application praying for dismissal of the instant revision on the ground of nonprosecution. It is submitted on behalf of the petitioner that the petitioners were already acquitted from the charge by the learned Additional Sessions Judge, 5th Court at Malda vide

judgment dated 12th September, 2022 in Sessions Case No.01 of 2022.

In view of such circumstances, the instant revision is dismissed for non-prosecution.

Let a copy of this judgment passed by the learned Additional Sessions Judge, 5th Court at Malda in Sessions Case No.01 of 2022 dated 12th September, 2022 be kept with the record.
