Laxman @ Laksman Hasda @ Ratha And ORS v. State Of West Bengal

08.06.2023 sdas rejected C.R.M.(DB) No. 2180 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Balurghat Police Station Case No. 468 of 2019 dated 16.09.2019 under Sections 341/323/302/34 of the Indian Penal Code.

And In Re : Laxman @ Laksman Hasda @ Ratha & Ors. .... petitioners Mr. Kaushik Choudhury ....for the petitioners Ms. Zareen N. Khan Mr. Ashok Das .... for the State Learned Counsel for the petitioners submits they are in custody for over 300 days. It is also submitted there is delay in trial. They pray for bail.

Learned Counsel for the State opposes the prayer for bail and submits date has been fixed for examination of witnesses.

We have considered the materials on record. Bail prayer of the petitioners was rejected earlier on merits. Allegations against the petitioners are grave and would attract life imprisonment if proved. Vulnerable witnesses have not been examined as yet. Under such circumstances, we are not inclined to grant bail to the petitioners.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
