Mr. Ayan Bannerjee, learned State counsel appears for the State-respondents.

The petitioners claim to be the land loser in respect of a land acquired in connection with L.A. Case No. II/71 of 1976-77. But no compensation has yet been paid. The petitioners submitted representation last of which is dated January 20, 2021 annexure p-11 at page-35 to the writ petition through its advocates letter, the same has not been considered and no compensation has been paid.

Considering the above, the respondent no.2 is directed upon issuing a prior hearing notice to the

petitioners and interested parties, if any, and after granting them an opportunity of hearing shall dispose of the representation dated January 20, 2021, as referred to above, by passing a reasoned order in accordance with law The respondent no.2 shall carry out and complete the entire exercise positively within a period of eight weeks from the date of communication of this order and the reasoned order shall be communicated to the petitioners and such interested parties, if any, positively within a further period of two weeks from the date of the said reasoned order to be passed. After ascertaining and crystalising the compensation payable to the petitioner together with interest in accordance with law.

The appropriate State authorities shall disburse and pay compensation to the petitioners and to such interested parties, if any, positively within a further period of ten weeks from the date of the said reasoned order to be passed. It is made clear that this Court has not gone into the merits of the claim of the writ petitioners and such interested parties, if any, and they shall be at liberty to urge whatever points they wish to urge by relying upon whatever records and documents they wish to rely upon before the respodnentno.

travel beyond the scope of the said representation dated January 20, 2021 Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions, this writ petition, WPA 14070 of 2024 stands disposed of, without any order as to costs.
