Mr. Kishore Datta Ms. Sumita Shaw Mr. Nilendu Bhattacharya Mr. Soumen Chatterjee ......for the petitioners Mr. Samrat Sen Mr. Nilotpal Chatterjee Mr. Amritalal Chatterjee ..... for the State The relief sought for by the petitioner is for a direction on the District Magistrate, Bankura to consider two representations made by the petitioner on 1st June, 2022 and 13th June, 2022 for extension of a mining lease dated 14th July, 2017 for allocation of a sand block to the petitioner. The petitioner was the successful bidder and the concerned sand block was allotted to the petitioner in 2017. The petitioner had also been allotted a different sand block which was subsequently changed by reason of an underground facility discovered in the earlier sand block. The petitioner says that the petitioner was unable to excavate in light of the subsequent lockdown by reason of the pandemic.

Whatever may be the contentions of the parties, the present writ petition can be disposed of with the direction on the District Magistrate, Bankura to

consider a fresh representation made by the petitioner within four weeks from the date on which the representation is received by the District Magistrate, if made. The petitioner shall make the representation within seven days from date. The representations on record are not found to be sufficient and hence the direction for a fresh representation.

WPA 12559 of 2022 is disposed of in terms of the above.

This Court has not gone into the merits of the matter and the allegations made in the writ petition are deemed not to have been admitted since affidavits have not been called for.
