1. The petitioner's objection (Annexure P2, p.24) against illegal encroachment of the State Highway maintained by the PWD (Roads) is pending consideration.

2. None represents the respondents.

After hearing the petitioner, I dispose of the writ petition directing the Assistant Engineer, Kakdwip Highway Division, Public Works (Roads) Directorate, the third respondent herein, to consider the abovementioned representation and dispose of the same by passing a reasoned decision, after affording an opportunity of hearing to all the necessary parties, within a period of twelve weeks from the date of communication of this order.

In the event the aforesaid respondent is of the considered opinion that the construction has been made encroaching the government land, then necessary remedial measures shall be taken. 5.

The petitioner is directed to forward a copy of the representation to the aforesaid respondent at the time of communicating the order of the Court.

If unauthorized encroachment is detected, then necessary remedial steps shall be taken to remove the same.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
