Petitioner is aggrieved by the fact that in spite of entering into a lease agreement the petitioner is being resisted by the private respondents from carrying out their fishery.

Learned advocate for the private respondents, on the other hand, disputes the lease agreement and submits that the principal has expired much prior to the date of execution of the said agreement.

State has submitted a report. Report reflects that the person who signed namely, Tamal

Taru Sinha denied to have entered into any agreement with the petitioners.

Having considered that disputed question of facts are involved in the present case and the petitioner intends to establish his right with the aid of an agreement which is not accepted by the person who signed the same, I am of the view that it would not be fit and proper to interfere in respect of the rights of the parties.

However since the petitioner and the private respondents have a dispute, police authorities would only restrict themselves to ensure that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations WPA 12944 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
