It appears from the report that on 1st May, 2024, a proposed arbitration meeting was held between the petitioner and respondents at a tea shop beside Salar PS. A hot altercation ensued between the parties and due to apprehension of breach of peace and law and order, the 5th respondent intervened promptly and detained both Samiran Saha and Shamsuz Zaman at the police station. They were released upon execution of PR bond. The petitioner seeks preservation of the CCTV footage of the police station on the relevant date.

Learned counsel for the State submits that the CCTV footages outside the police station may not be available due to passage of time.

It appears that the complaint lodged by the petitioner has not been acted upon. The petitioner is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS for redressal of her grievance.

The CCTV footages of the police station as on 1st May, 2024 be preserved for the purpose of proper investigation. The CCTV footages in the vicinity of the police station, if available, be also preserved. The police shall keep strict vigil in the area in order to avoid any untoward incident in view of the strained relationship between the parties and shall ensure maintenance of peace and tranquility.

The police shall render necessary assistance/protection to the petitioner as and when sought.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
