(A) 2178 of 2023 09.06.2023 Sl. 15 Court No. 29 Suvayan (Allowed) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed in connection with G.R. Case No. 611 of 2023 pending before the learned CJM, Rampurhat, Birbhum, arising out of Margram Police Station Case No. 68 of 2023 dated 03.05.2023 under Sections 498A/304B/306/ 34 of the Indian Penal Code.

1. Heard learned Counsel for both the parties.

2. The petitioner is the mother-in-law of the deceased. The cause of death of the deceased is stated to be suicidal hanging.

3. Considered the materials placed by learned Counsel for the parties including the statement of the witnesses.

4. So far as the present petitioner is concerned there is omnibus allegation against her along with other family members regarding torture and harassment upon the deceased for fulfillment of demand of dowry though quantum of money and make of jewelry have not been specified in the statement of any of the witnesses.

5. The investigation is stated to have progress substantially.

6. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, nature of allegation against the petitioner and substantial progress in the investigation, it is directed that the petitioner shall be

released on bail by the Arresting Officer in the event of his arrest on such terms and conditions as deemed just and proper in the facts and circumstances of the case including the condition that the petitioner shall appear before the I.O. for the purpose of investigation till the submission of Final Form as and when required.

7. Within 15 days of the receipt of server copy or certified copy of this order, the petitioner is directed to appear before the I.O. alongwith a copy of such order.

6. Accordingly, the prayer for the anticipatory bail is allowed.
