Affidavit of service filed in Court today be retained with the records.

The petitioner alleges illegal encroachment over Government land.

An application praying for removal of the illegal encroachment is pending consideration at the end of the respondent authorities for a considerable period of time.

Without entering into the merit of the said application, the instant writ petition is disposed of by directing the Executive Engineer, Public Works Department, Government of West Bengal, being the respondent no.6 herein to consider the said application. A spot inspection shall be conducted upon notice to all the necessary parties to ascertain the allegation of encroachment of Government land within a period of

four weeks from the date of communication of this order.

If it ultimately transpires that the allegation of the petitioner is correct, then necessary remedial steps shall be taken for removal of the illegal encroachment in accordance with law.

Steps shall be taken to finally dispose of the prayer of the petitioner at the earliest but positively within a period of eight weeks from the date of communication of this order.

Learned advocate for the petitioner is directed to forward a copy of the application dated 22nd March, 2021 to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.
