This is an application for recalling of an order of dismissal of the writ petition, passed on September 22, 2025.

Sufficient grounds have been made out as to why the Advocate of the petitioner was unable to attend the matter on the date of dismissal.

The application is allowed and WPA 13268 of 2025 is restored to file.

The application being CAN 1 of 2025 is disposed of. WPA 13268 of 2025 5.

The writ petitioner seeks direction on the respondent No.2 to dispose of an application under Section 14 of the Securitization and Reconstruction of Financial Assets and

Enforcement of Security Interest Act, 2002 (hereinafter the said Act), to expeditiously dispose of an application made under Section 14 of the said Act sometime in 2019. 6.

Mr.

Bhattacharyya appears for the private respondent and submits that the property has already been sold and that he has filed proceeding before the Debts Recovery Tribunal-II, Kolkata challenging such sale by the respondent Bank.

In view thereof, the present petition seeking directions on the respondent No.2 has become infructuous. 8.

Accordingly, the writ petition is dismissed.

There shall, however, be no order as to costs. 10.

Since affidavits have not been called for, the allegations contained in the petition are deemed to have been denied.
