1. Learned advocate for the petitioners submits that an order under Section 400(1) of the Kolkata Municipal Act, 1980 has been passed on 19th April 2024. The petitioners have a statutory remedy and are otherwise interested to proceed with the same.

2. Learned advocate for the petitioners submits that in the interregnum, this Court should afford protection to the petitioners. From the aforesaid disclosure made by the petitioners as appearing at page 25 of the writ petition, it is apparent that the Special Officer (Building), has passed the order on 9th April 2024. The statutory period for preferring the appeal has also expired.

3. Be that as it may, since the petitioners are interested to prefer a statutory appeal, this Court is not inclined to entertain the writ

petition.

Since, the writ petition is not entertained, question of granting any interim relief cannot arise.

4. Accordingly, the writ petition is dismissed. (Raja Basu Chowdhury, J.)
