1. Despite service, none appears for the respondents at the time of call. Affidavit-of-service filed today be kept on record.

2. The petitioner makes an innocuous prayer for adjudication of the petitioner's application under Section 5(3) of the West Bengal Thika Tenancy (Acquisition and Regulation) Act, 2001 (hereinafter referred to as "the 2001 Act"), which is yet pending, despite such application having been made on February 10, 2023 before the Thika Controller, Howrah.

3. Accordingly, WPA No. 12970 of 2023 is disposed of by directing the respondent no.2, the Controller, Thika Tenancy, Howrah to allot a number to the petitioner's application under Section 5(3) of the 2001 Act, as annexed at page-13 of the present writ petition, and to dispose of the said application expeditiously in accordance with law, upon giving

opportunity of hearing to all concerned including the petitioner.

4. It is expected that such adjudication shall be completed within an outer limit of three months from the date of communication of this order to the respondent no.2.

5. There will be no order as to costs.

6. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
