1. Affidavit-of-service filed today be kept on record.

2. Regarding service on the private respondent, it transpires that service could not be effected because the door of the private respondent was found locked although the address has not been stated in the postal endorsement to be wrong. Hence, it is deemed that good service has been effected on the private respondent.

3. Learned counsel for the petitioner submits that due to resistance by the private respondent, the writ petitioner is not getting electricity connection, which stand is corroborated by learned counsel for the WBSEDCL.

4. The report filed by the police be kept on record.

5. Since the petitioner, being in occupation of the premises, is entitled to electricity connection, WPA No. 14120 of 2024 is allowed, thereby directing the WBSEDCL to give electricity connection to the petitioner within a fortnight

from date subject to compliance of all formalities by the petitioner.

6. In the event any resistance is offered by the private respondent and/or his men and agents, the WBSEDCL personnel shall approach the respondent no. 5, the Officer-in-Charge, Joynagar Police Station who, acting on a server copy of this order and at the cost of the petitioner, grant such assistance to the WBSEDCL personnel, if necessary by removing any padlock or other hindrance to facilitate the same.

7. There will be no order as to costs.

8. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
