Ms. Sukla Das Chanda ..for the State Mr. Partha Sarathi Mondal .for the respdts.5-7 The petitioner alleges that the police authorities of Shibpur Police Station had not assisted the petitioner during installation of a motor pump. There is a matrimonial dispute. A complaint was filed by the petitioner. The investigation ended with the filing of a charge sheet. The petitioner now prays for police assistance so that she can install a separate motor pump and water supply line.

Although, there is a trial pending against the respondent nos.5 to 7 on the basis of the complaint filed by the petitioner, the petitioner resides in the same premises, as the said respondents. The petitioner is 40% disabled and as such the said respondents should not disturb the petitioner, but allow her to use the facilities from the common water supply. Mr. Mondal submits that the petitioner was never prevented from using the common water

supply facility available at the premises. The police authorities shall keep a strict vigil.

Under such circumstances, this writ petition is disposed of with a direction upon the Officer-inCharge, Shibpur Police Station, to ensure that the petitioner is allowed to enjoy the running water facilities at the premises in question and the respondent nos.5-7 shall not disturb the petitioner for such usage.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
