The petitioner is aggrieved by the manner in which the long delay of preferring an appeal against an order of conviction has been condoned by the learned Chief Judge, City Sessions Court.

I find from the records that the substantial grievance of the petitioner is not unjustified. However, the next date has been fixed on 20.06.2023 for consideration of the stay application of the appellant. I direct that in case, the learned appellate court decides to stay the judgment and order of conviction and sentence passed by the learned trial court, in that case, the learned appellate court would pass a direction for depositing an amount of 50% of the compensation amount decided by the learned trial court to be deposited with the trial court during the pendency of the appeal. The complainant/petitioner would be at liberty to exercise his power as enshrined under the provisions of the Negotiable Instruments Act.

No adjournment should be granted on 20.06.2023 to the appellant and the appeal must be heard at the earliest. With the aforesaid observations, the revisional application being CRR 2032 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
