In the matter of : Gita Saroj.
... Petitioner.
Mr. S. Bhattacharya, Mr. Debapriya Majumder.
...for the Petitioner.
Mr. Sudip Ghosh, Mr. Bitasok Banerjee.
...for the State.
Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 77 days. It is submitted there is no direct evidence connecting her with the crime. Learned Advocate for the State opposes the prayer for bail and submits petitioner had an illicit relationship with the deceased which had turned sour. She along with co-accused committed the murder. Investigation is in progress. We have considered the materials on record. Statements of witnesses and other materials show there was an illicit relationship between the petitioner and the deceased. CDRs show communication between the deceased and the petitioner immediately prior to the incident. Petitioner had motive to commit the crime. Investigation is in progress. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail of the petitioner is rejected.
