Mr. Ranabir Roy Choudhury Ms. Snigdha Saha ... For the State Report submitted by the State is taken on record. Learned counsel for the petitioner submits that the petitioner's name is Durgat Sarkar though he has been arrested as Biplab Sarkar. All the documents produced by the petitioner are in connection with Durgat Sarkar. Though the names of the petitioner's parents appear to be late Ranjit Sarkar and Marani Sarkar in the documents produced by him, learned counsel for the State submits that they are in fact the uncle and aunt of the petitioner and his birth certificate depicts a different name as his father.
There are several anomalies in the documents produced by the petitioner which need to be thrashed out in trial. The petitioner is in custody for more than a year. The prosecution proposes to examine 5 witnesses.
In the event the petitioner is released on bail at this stage, chances of his abscondence cannot be ruled out.
Accordingly, the prayer for bail is rejected at this stage.
Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
The application for bail is disposed of.
