Petitioners seek anticipatory bail.
Learned Advocate appearing for the petitioners submits that there are long-standing property disputes between the de facto complainant and the petitioners. Moreover, the principal accused was granted bail by the Sessions Court. Learned Advocate appearing for the State submits that there are statements recorded under Section 164 of the Criminal Procedure Code implicating the petitioners.
Considering the facts and circumstances of the case and considering the fact that there are property disputes between the de facto complainant and the petitioners and the fact that the principal accused was granted bail, we are of the opinion though custodial interrogation of the petitioners may not be necessary, petitioners are required to cooperate with the investigation in accordance with law.
Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a Bond of Rs.10,000/- each with two sureties of like amount each to the
satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that they shall appear before the jurisdictional Court and pray for regular bail within four weeks from date.
The application for anticipatory bail being C.R.M. 5717 of 2021 is, thus, disposed of.
