Mr. Asim Hati, learned advocate for the petitioner, submits that due to obstruction caused by Respondent No. 8, the petitioner has been unable to install a gate in front of the shop in question, despite having obtained permission from the landlord to do so, in order to ensure the safety and security of the premises.

Respondent No. 8 is not represented at the time of the hearing.

The police report indicates that a charge sheet has been submitted against Respondent No. 8 under Sections 341, 323, and 506 of the Indian Penal Code in connection with Burrabazar P.S. Case No. 98, dated May 18, 2024.

In light of the foregoing, I direct the Officer-inCharge, Burrabazar Police Station, to ensure that the petitioner is allowed to install the gate in front of the shop room on the ground floor and that no obstruction is caused by Respondent No. 8 in this regard.

It is further clarified that if any obstruction is created by Respondent No. 8, the Officer-in-Charge, Burrabazar Police Station, shall take immediate and appropriate action.

Accordingly, WPA 14117 of 2024 is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
