Affidavit of service filed by the petitioner is taken on record.

The petitioner complains that the private respondents have raised illegal construction on Government land, obstructing his egress and ingress. The petitioner filed an application under Section 10 of the West Bengal Highways Act, 1964 before the respondent no.3 on 20th July, 2021 ventilating his grievance, but the said representation is yet to be disposed of. The petitioner prays for disposal of the said representation at an early date.

Having considered the submissions made on behalf of the parties as well as the material on record, I dispose of the writ petition with a direction upon the respondent no.3 to consider and dispose of the representation filed by the petitioner on 20th July, 2021, within a period of three months from the date of communication of this order after affording reasonable

opportunity of hearing to all the interested parties including the petitioners and the private respondents, in accordance with law.

With such observation, WPA 13681 of 2021 is disposed of. However, there shall be no order as to costs.

Since no affidavits are invited, the allegations contained in the petition are deemed not to be admitted.
