JM, 4th Court, Howrah under section 138 of the N.I. Act.

Ld. advocate submits that the examination in chief of P.W.1 is over and since the year 2022, the crossexamination of P.W.1 has been deferred on different pretext. According to the petitioner, the accused persons have been adopting dilatory procedures for stretching the time of the trial, which is prejudicial to the interest of the complainant as also against the purpose for which the provisions of the Act has been brought into force. Having considered that the complainant's case initiated in the year 2017 and, more than six and half years have expired in the meantime, I direct the ld. trial court to fix at least one date in every two months so that the trial of

the case can be taken to its logical conclusion within a reasonable period of time. All efforts be taken to conclude the cross-examination of P.W.1 within three months from the next date so fixed. The ld. trial court would, thereafter, fix dates in such a manner that by 31st of December, 2025, the verdict of the present case can be pronounced. With the aforesaid observations, CRR 2062 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
