Mr. Pratip Mukherjee, Ms. Rima Banerjee, Mr. Dmar Faruk Gazi ....for the petitioner Mr. Pantu Deb Roy, ld. A.G.P., Mr. Anand Farmania .....for the State The petitioner is an accused in a proceeding under the Drugs and Cosmetics Act, 1940. He is a co-owner of a property where the M/s. Sustha Pharmacy is located. The petitioner is only a coowner of the property where the pharmacy is located.

The petitioner submits that the other partners of the said business have not been dealt with by the authorities.

Admittedly, the petitioner's application for anticipatory bail has been rejected.

He is absconding. No relief can, therefore, be granted to the petitioner under Article of the Constitution of India.

With the aforesaid observations, WPA 13670 of 2021 shall stand dismissed.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
