Mr. Arjun Ray Mukherjee Mr. Pratip Mukherjee ..........for the petitioners Mr. Samrat Sen Ms. Manali Ali ..............for the State The petitioners are aggrieved by cancellation of a Letter of Intent for a mining lease. The Letter of Intent was cancelled on 13.08.2019 and the petitioners made a representation before the authorities on 15.01.2020.

Learned counsel appearing for the petitioners refers to several facts by reason of which the petitioners were unable to comply with the terms of the Letter of Intent or deposit the amounts which the petitioners were required to do. Counsel also mentions that the petitioners lodged an FIR against the twenty-five miscreants who looted the money from the petitioners which was also another reason why the petitioners could not comply with the requirements.

Learned counsel appearing for the State submits that the representation of the petitioners was rejected by the State-respondents by an order dated 24.09.2020. According to counsel for the petitioners, this order was not served on the petitioners.

Since the order of rejection of the Staterespondents dated 24.09.2020 is not on record and admittedly was not served on the petitioners, the petitioners are given leave to withdraw the writ petition and file afresh if necessary.

WPA 13627 of 2021 is accordingly dismissed as withdrawn.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
