1. Heard learned Counsel for both the parties.

2. The petitioner is a consumer under the appropriate DISCOM. Electricity dues of Rs. 1,97,377/- is stated to be outstanding against the petitioner. Charge-sheet is stated to have been filed in the meantime.

3. The investigation is stated to have progressed substantially.

4. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, substantial progress in the investigation and nature of offence, it is directed that the petitioner shall be released on bail by the Arresting Officer in the event of his arrest on such terms and conditions as deemed just and proper in the facts and circumstances of the case in connection with Bhupatinagar P.S. case No. 56 of 2023 dated 16.02.2023 including the conditions that the petitioner undertakes to deposit the 50 per cent of the assessed amount within 6 weeks from today and on deposit of the amount requisite receipt be filed before the concerned electricity Court of the District.

5. Within three weeks of the receipt of server copy or certified copy of this order, the petitioner is directed to appear before the I.O. along with a copy of such order.

6. Accordingly, the prayer for the anticipatory bail is allowed.
