Prasenjit Sarkar Mr. Mrityunjoy Chatterjee Mr. Debopriya Majumder Mr. Arindam Poali ...for the petitioner This application under Section 24 of the Code of Civil Procedure is at the instance of the wife praying for transfer of the Matrimonial Suit No.1113 of 2021 which is presently pending before the learned Additional District Judge, 2nd Court at Barrackpore.

The petitioner claims to be a resident of Beliaghata. Considering the distance between the residence of the petitioner and Barrackpore Court, this Court is not inclined to entertain the prayer for transfer of the Matrimonial Suit from Barrackpore Court to the Family Court at Kolkata.

At this stage the learned advocate for the petitioner submits that an application under Section 36 of Special Marriage Act praying for alimony pendente lite is pending and the same has been fixed for hearing sometimes in the month of May, 2025. He prays for a direction upon the learned Trial Judge to dispose of the said application expeditiously.

In the light of the aforesaid submissions made by the learned advocate for petitioner CO 1819 is disposed of by requesting the learned Additional District Judge, 2nd Court, at Barrackpore to take up the hearing of the application under Section 36 of the Special Marriage Act, if the same is otherwise ready for hearing, on the next date fixed and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

The learned advocate on record of the petitioner is directed to forward a copy of this application along with this order to the opposite party or the learned advocate representing the opposite party before the learned Trial Judge.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
