Mr. Tapodip Gupta ...for the petitioner Ms. Antarikhya Basu Ms. Pallavi Priyadarshee ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been implicated in this case only on the basis of the statement of the co-accused, which is inadmissible in evidence.

Similarly circumstanced co-accused was granted anticipatory bail.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail, relies on the case diary and submits as follows. The person, who was granted anticipatory bail, had a valid drug licence. But, the licence of the present petitioner as produced by a co-accused was found to be fake. More particularly, there are GST documents showing that on the basis of such fake licence, drugs had been delivered/was to be delivered to the present petitioner.

In view of the incriminating materials available in the case diary including the report showing that the petitioner's drug licence,

though produced by a co-accused, was found to be fake and there was transaction based on such licence as would be evident from GST documents and considering the restriction contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner in this case.

Accordingly, the prayer for anticipatory bail to the petitioner is rejected.
