Petitioner is aggrieved by the act and action of the police authorities, petitioner claims that inspite of the Executive Magistrate passing order and the police authorities being informed, the private respondents are carrying out construction in the material land.

Learned advocate appearing for the state has submitted a report. Report reflects that the police authorities have drawn up proceedings under section 107/116 of the Cr.P.C.

Petitioner complains that without appropriate conversion by the authorities construction of building is in progress.

Petitioner will submit a representation to the BL&LRO if the BL&LRO finds that without conversion of the land, the construction of the building is in progress, he would communicate the order to the concerned Officer-in-Charge/Inspector-in-Charge. The Inspector-in-Charge would be bound by the orders passed by the BL&LRO in respect of his findings and implement the order passed.

With the aforesaid observations WPA 14130 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
