It should be clarified that by the judgment passed by this Court on 3rd May, 2023, ESI Hospital was directed to revisit the evaluation of the financial bids submitted by the bidders including the petitioners and arrive at a fresh decision within a certain timeframe.

The decision dated 12th May, 2023 passed by the ESI Hospital appears to be a detailed order. It is relevant to say that the ESI Hospital was only directed to revisit its earlier decision and make a

fresh evaluation in accordance with the terms of the tender and if the petitioners have any continuing grievance against the alleged contemnors or the decision dated 12th May, 2023, which was in compliance with the judgment and order passed by this Court, the petitioner must approach the Bench which presently has determination to hear these matters with a fresh writ petition.

CPAN 764 of 2023 is disposed of in terms of the above.
