In Re: An application under Section 482 of the Code of Criminal Procedure, 1973.

Nabanita Ghosh & Ors.

Versus

The State of West Bengal Ms. Baisali Basu.

...for the State.

As none appears on behalf of the State, Ms. Baisali Basu, learned advocate, who ordinarily appears for the State, is directed to appear and assist the Court. Her appointment may be regularised by the concerned authorities.

The revisional application was preferred challenging the proceedings arising out of Jagaddal Police Station Case No.359 of 2011 dated 14.07.2011 under Section 306 of the Indian Penal Code. Records of the revisional application reflect that till date no interim order was there restraining the proceedings before the learned court below to proceed.

Having regard to the nature of materials, which have been collected by the investigating agency and the stage at which the petitioners approached this Court, I am of the view that no interference is called for.

Accordingly, CRR 1886 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
