Affidavit of service filed in Court is taken on record. It appears that a communication was made from the office of the Commissioner, School Education Directorate, (Primary Branch) dated 18th March, 2020 to the Vice Chancellor of the Sanskrit College and University regarding approval of appointment of Sri Sanjay Mukherjee as a servant of Bijoy Chatuspathi Government Sponsored Sanskrit Tol, Burdwan.

The grievance of the petitioner is that the same has not been considered by the Vice Chancellor of the Sanskrit College and University till date.

It has been submitted that the petitioner is serving in the Institute since 1st September, 2016 and his appointment was made after following a regular selection process.

The learned advocate representing the State respondents submits that the appointment of the petitioner was not made in accordance with the provisions of law.

Be that as it may, as it appears that the Commissioner, School Education Directorate directed the Vice Chancellor, Sanskrit College and University to place the matter before the expert committee for checking, verification and for taking appropriate action in the matter, accordingly, the instant writ petition is disposed of by directing the respondent Nos. 8 and 9 to take prompt necessary action in terms of the communicating memo dated 18th March, 2020 at the earliest, but positively, within a period of eight weeks from the date of communication of a copy of this order. The aforesaid respondents shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

If required, the aforesaid respondents may afford an opportunity of hearing to the petitioner and any other necessary parties to place relevant documents in support of the claim of the petitioner for approval of appointment.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
