Mr. Arunava Ganguly, Mr. Asfak Ahammed ...for the petitioner Mr. Sumit Ray ...for the WBSEDCL Affidavit-of-service filed in Court today be kept on record.

Learned counsel for the petitioner contends that, the WBSEDCL is not giving a new electric connection to the petitioner, in spite of the petitioner having applied for a new connection and despite the existence of an electric pole on the petitioner's land.

Learned counsel appearing for the Distribution Company submits that the application made by the petitioner for new connection was incomplete on various aspects. As such, it is submitted, no inspection could be held for the purpose of giving connection. Hence, the matter can be resolved in the event the petitioner is permitted to apply afresh in accordance with law.

Accordingly, W.P.A. No. 13683 of 2021 is disposed of by granting liberty to the petitioner to apply for electric connection afresh, complying with all legal formalities, further ensuring that the application is complete in all respects and is accompanied by the requisite documents.

Upon such an application being made, the Distribution Company shall hold an inspection and decide on the new connection being given to the petitioner in accordance with law.

In the event the petitioner is otherwise found eligible to have such connection, the Distribution Company shall endeavour to give such new connection at the earliest after such inspection.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
