1. We have heard the learned Counsel for the parties.

2. It appears that the petitioner is aggrieved by the recommendation made by the Director of Public Instruction. During the pendency of this petition, an application has been filed by the Principal of the College praying for modification of the order that the petitioner has given preference to the Acharya Jagadish Chandra Bose College and not the Tamralipta Mahavidyalaya, Tamluk, Purba Medinipur which would, in fact, be closed where he is presently residing and would apprise the grievance of the petitioner that he would be

required to travel long distance. In fact, we have directed the authorities to consider the representation keeping in mind the factors mentioned in paragraph 3 of the order since the authorities have decided to transfer the petitioner to Tamralipta Mahavidyalaya, Tamluk, Purba Medinipur which would take care of his grievance of long distance, which may not enable him to look after his old ailing parents, we find that the order has been substantially complied with.

3. Accordingly, the contempt application and the recalling application being CAN 2 of 2024 stand disposed of.

4. However, there shall be no order as to costs.

5. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
