Mr. Soumen Bhattacharjee Mr. Ankan Das Ms. Shradhya Ghosh .....For the Petitioner Mr. Pantu Deb Roy Mr. Pannalal Bandopadhyay .......For the State The petitioner seeks issuance of a Writ of Mandamus commanding the respondents to act in terms of the resolution adopted by the Board of the State Transport Authority in its meeting held on August 21, 2024, by endorsing the new alignment of route through Park Circus to Science City Via Minto Park, Sealdah and Beliaghata on the permit of the petitioner.
Mr. Bhattacharjee, learned advocate appearing for the petitioner invites the attention of this Court to the resolution adopted by the Board of the State Transport Authority in its meeting held on August 21, 2024 to demonstrate that the variation of the petitioner's route as requested by
the petitioner had been approved by the Board of the State Transport Authority in its said meeting. It is submitted that despite such variation having met with an approval of the Board of the State Transport Authority, the State Transport Authority has not yet endorsed the new route alignment on the petitioner's permit.
It is submitted that in such view of the matter the petitioner made a representation before the Secretary, State Transport Authority seeking implementation of the resolution adopted by the Board of the State Transport Authority in its meeting held on August 21, 2024. The said representation dated September 26, 2024 (Annexure 'P-3' to the writ petition at page 23 thereof) has also not been considered. It is submitted that the petitioner followed up the said matter by another representation made through his learned advocate on May 18, 2025, but the respondent State Transport Authority has still remained inactive.
Having heard the learned advocates appearing for the parties and having considered
the material on record, this writ petition is disposed of by directing the respondent no.3 to consider and dispose of the petitioner's representations dated September 26, 2024 and May 28, 2025 by a reasoned order within a period of four weeks from the date of communication of the order, upon affording an opportunity of hearing to the writ petitioner, strictly in accordance with law.
It is needless to mention that the reasoned order that shall be passed by the respondent no.3 within the aforesaid time frame, shall be communicated to the writ petitioner within a week from passing thereof.
With the aforesaid observation WPA 12773 of 2025 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
