Petitioners Mr. Sujoy Sarkar Mrs. Sneha Srivastava ... for the Petitioners Mrs. Sonali Das Mrs. Diksha Ghosh ... for the State The petitioners are the members of the matrimonial family of the victim who committed suicide in her matrimonial home within three years of marriage. Learned counsels for the State opposes the prayer. I have considered the material on record. The main thrust of the allegation is against the husband of the victim who was arrested and subsequently released on bail. Allegation against the petitioners are general and omnibus. Material available on record does not justify the custodial interrogation of the petitioners. Whether the conduct of the petitioners can be said to be the proximate cause for commission of suicide by the victim shall be

assessed at the appropriate stage of trial. Hence, this Court is inclined to grant anticipatory bail to the petitioners. Accordingly, in the event of arrest the petitioners (1) Pampa Das Bairagya, (2) Sampa Das Bairagya, (3) Pranab Das Bairagya, (4) Kalyani Das Bairagya and (5) Debendra Das Bairagya be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date. The application for anticipatory bail is, thus, disposed of.
