On the basis of an order dated 24th August, 2022, the petitioner and the private opposite party No.2 have filed two separate affidavits. It is ascertained from the contents made in affidavit that both the petitioner and opposite party pray for an order disposing of the instant petition on the basis of the affidavits filed by them. The instant revision has been filed praying for quashing of the proceeding in respect of CGR Case No.619 of 2021 arising out of Tollygunge Police Station Case No.40 of 2021 dated 24th February, 2021 under Sections 354D/457/427/352/506/509 of the Indian Penal Code. In the affidavit affirmed by both the parties it is stated that the aforesaid case was filed due to some misunderstanding and misconception between the de facto complainant and the private opposite party.

The de facto complainant at present wants that she and her family members should not be contacted by opposite party No.2 henceforth and the opposite party No.2 would not spread baseless and merciless rumours about her and her family members through traditional as well as electronic mode. The opposite party No.

communication through traditional and electronic mode with her and her family members and he ensures that no such communication be made from his family members also. He also undertook that he will not spread any misinformation and baseless reumour against the opposite party or her parents.

Both the affidavits be taken on record.

In view of such settlement arrived at by and between the de facto complainant/opposite party No.2 and the petitioner, further proceeding in CGR Case No.619 of 2021 arising out of Tollygunge Police Station Case No.40 of 2021 dated 24th February, 2021 under Sections 354D/457/427/352/506/509 of the Indian Penal Code be quashed.

The instant revision is, thus, disposed of.
