For the State Mr. Sarwar Jahan, learned counsel appearing for the petitioner in his usual fairness, submits that, the cause in this writ petition should be agitated before the jurisdictional State Administrative Tribunal and not before this Writ Court.

Mr. Debopriyo Karan, learned counsel appears for the State.

In view of the above, this writ petition W.P.A. 13139 of 2025 stands dismissed, without any order as to costs on the ground of alternative remedy being there and not on merit.

This order of dismissal shall not preclude the petitioner to initiate appropriate proceeding before the jurisdictional State Administrative Tribunal on the same set of facts and on the self-same cause of action.

The petitioner shall be at liberty to file the proceeding before the Tribunal within a period of four weeks from date.

In the event, such proceeding is filed before the jurisdictional State Administrative Tribunal, the Tribunal shall proceed with the same and come to its logical conclusion as expeditiously as possible.

It is made clear that, this court has not gone into the merits of the rival contentions of the parties and all points are kept open for the parties to urge before the Tribunal.
