Mr. Das, learned advocate appearing for the petitioner submits that the petitioner's wife went missing on and from 19th March, 2022. Initially a missing diary was registered on 23rd March, 2022. Thereafter, the petitioner lodged a complaint on 11th June, 2022 and the same was registered as Sonarpur Police Station Case no.663 of 2022. Subsequent thereto, the police authorities did not take any appropriate steps and as such, the petitioner was constrained to prefer the present writ petition.
Mr. Kabir, learned advocate appearing for the State submits that there was a matrimonial dispute between the petitioner and his wife and that she is not willing to return to her matrimonial house. In support of such contention, Mr. Kabir has filed before us a statement of the petitioner's wife wherein she has inter alia stated that as there was a matrimonial dispute, she lodged a complaint against her husband in the Sonarpur Police
Station on 19th March, 2022. She left her matrimonial house willingly and is presently residing at 210, Netaji Subhas Road, Kolkata - 700 150 and is working as a maidservant at Nagerbazar. Let the documents, as produced, be kept on record.
Heard the learned advocates appearing for the respective parties.
We do not find any material on record to infer that the petitioner's wife had been illegally detained. She is residing at 210, Netaji Subhas Road, Kolkata - 700 150. In view thereof, no further interference is called for in the present habeas corpus petition, being WPA (H) 39 of 2022 and the same is, accordingly, disposed of. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
