Orders dated 5th February, 2020 and 20th December, 2021 passed by the learned Additional Sessions Judge, 6th Court at Barasat-cum-Special Judge, NDPS Act in Case No.N-196 of 2018 directing issuance of warrant of proclamation and attachment is under challenge in the instant criminal revision on the ground that

provisions of Sections 82 & 83 of the Code of Criminal Procedure have not been followed.

This Court is of the view that the instant matter can be disposed of here and now with the assistance of the learned Advocate for the State.

Mr. Anwar Hossain, learned Public Prosecutor-in-Charge is requested to assist this Court on behalf of the State of West Bengal. Having heard the learned Advocate for the petitioner and the learned Public Prosecutor-in-Charge, this Court dispose of the instant criminal revision with a direction to the petitioner to surrender before the Court below within three weeks from the date of this order. The Trial Court shall pass necessary order against the petitioner on his surrender in accordance with law. Let a copy of this order be sent to the learned Court below for information and compliance.
