The 10th Court of learned Civil Judge (Senior Division) at Alipore, District : 24 Parganas (South) is taking analogous hearing of two suits one for specific performance of an alleged agreement for sale being Title Suit No. 95 of 2012 and another for recovery of possession of the suit property being Title Suit No. 87 of 2016.

The petitioner is the plaintiff of the said suit for recovery of possession.

The petitioner is complaining inordinate delay in disposal of the said suits. The opposite party, the plaintiff of the suit for specific performance has also the same grievance. The parties are praying for a direction upon the learned Trial Judge for expeditious disposal of those suits. The parties are interested in speedy disposal of the said suits as such it can be presumed that they will co-operate with the learned Trial Judge in disposing the said suit expeditiously.

The learned Trial Judge is requested to make all endavour to dispose of the said suits as expeditiously as

possible without granting any unnecessary adjournment to either of the parties.

CO 1527 of 2021 is thus disposed of without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
