The petitioner is aggrieved by the inaction of the police authorities as he complains of being assaulted by the private respondent. The petitioner submits that there has been interference with the rights of the petitioner at the behest of the private respondent and to that effect also refers to a document being the emergency ticket of Magrahat Rural Hospital.

Learned advocate appearing for the private respondent no.5 submits that the issues complained of are purely civil dispute which are to be adjudicated by the civil court.

Learned advocate appearing for the State submits that the information which was received from the petitioner was reduced to a G.D. Entry. I have considered the nature of the dispute which has its genesis in respect of the properties. However, the petitioner has been assaulted. I have considered the injury report and since the police

authorities did not take any step, petitioner would approach the jurisdictional criminal court for appropriate reliefs. The jurisdictional criminal court would assess, ascertain the genuinity of the allegations and thereafter pass directions as he deems fit and proper.

Police authorities would oversee that there is no breach of the peace and/or tranquility arising from the dispute between the petitioner and the private respondent.

With the aforesaid observations, the writ petition being WPA 12975 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
