Learned counsel for the petitioners submits that the case is a result of mob fury and the petitioners have been falsely implicated. The mother of the victim who has been examined as PW-1 has named the petitioners in her evidence on instructions. She is not an eye witness to the incident. Learned counsel for the CBI opposes the prayer.

I have considered the material on record. A person has been beaten to death. The petitioners have been implicated by several eye witnesses to the incident. These witnesses are yet to be examined. This Court is informed that the witnesses are being threatened for which a general diary has been lodged.

Considering the gravity of the offence and prima facie involvement of the petitioners therein, prayer for bail is rejected at this stage.

The bail application is disposed of.

Case Diary is returned.
