1. Affidavit of service filed in Court today is taken on record.

2. The petitioners' objection alleging encroachment of public road is pending consideration for a considerable period of time.

3. Learned advocate for the State respondents is not ready with proper instruction in the matter.

4. As it appears that the objection of the petitioner is pending before the Public Work Directorate, accordingly, the instant writ petition is disposed of by directing the Assistant Engineer, Tehatta Highway Sub Division PWD Roads being the respondent no. 6 herein to take into consideration the objection filed by the petitioners in accordance with law at the earliest and dispose of the same after giving reasonable opportunity of hearing to all the necessary parties.

5. A reasoned order shall be passed and communicated to the parties.

6. If the allegation made by the petitioners is found to be proper, then necessary remedial steps shall be taken for removal of the encroachment.

7. Steps shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.

8. Learned advocate representing the petitioners is directed to forward a copy of the representation along will all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
