A demolition order was issued by the Howrah Municipal Corporation concerning the premises located at RS Dag No. 4201, LR Dag No. 4660, Khatian No. 1895, under the jurisdiction of the Santragachi Police Station, Ward No. 46, Howrah Municipal Corporation.

The petitioner's grievance is that although the Corporation executed the demolition in two phases during January 2025, a subsequent demolition notice dated June 2, 2025, has again been issued by the Corporation for further demolition.

Learned counsel for the petitioner has relied upon the orders dated March 4, 2025, passed in MAT 95 of 2025 and June 9, 2025, passed in FMA 609 of 2025, submitting that the petitioner

is willing to apply for a fresh sanction plan, which ought to be considered by the Corporation in accordance with the law.

I find no reason to deny the petitioner's prayer.

Accordingly, this writ petition is disposed of, granting the petitioner liberty to submit an application for a sanction plan via offline mode within 15 days from the date of this order.

The Howrah Municipal Corporation shall consider the application in accordance with the law within two months thereafter.

Until the Corporation has considered the petitioner's application for the sanction plan, it shall refrain from undertaking any further demolition activities with respect to the said premises.

Accordingly, WPA 12778 of is disposed of.
