Mr. Pankaj Halder Mr. Bidish Ghosh ... for the petitioner Mr. Dwarika Nath Mukherjee Mr. Manick Lal De ... for the State-respondent This writ petition has been filed seeking direction upon the respondents and their men, agents and assigns to release the admitted bill amount of Rs.1,76,482/- against the work executed towards reconstruction of school.

The petitioner contends that work order was issued by the Block Development Officer, Mathurapur-II Panchayat Samity, District South 24-Parganas, for reconstruction of Kashinagar Girls' High School affected by Amphan Cyclone, which has been duly completed successfully. However, the admitted bill amount of Rs.1,76,482/- has not been released as yet. Hence, this writ petition.

Mr. Dwarika Nath Mukherjee, learned Advocate for the State-respondents submits that an amount of

Rs.1,75,263/- is admittedly due to the petitioner. However, due to lack of fund the same could not be paid as yet. He files report of the Block Development Officer, Mathurapur-II Development Block dated 28th November, 2024, which is taken on record.

Mr. Pankaj Halder, learned Advocate for the petitioner seeks for necessary direction for release of the admitted bill amount.

Perused the aforesaid report of Block Development Officer, Mathurapur-II Development Block.

It is reported by the Block Development Officer that the work has been completed as per MB No.316/2020-21, recorded at page no.24 to 29 and the amount of Rs.1,75,263/- has been signed by Junior Engineer (R.W.S.), Public Health Engg. Dte., Mathurapur-II Dev. Block dated 12.08.2021.

In view of above, the respondent no.2, the District Magistrate, South 24-Parganas is directed to take appropriate steps for release of the admitted amount of Rs.1,75,263/- in favour of the petitioner within a period of two months from the date of communication of this order.

The petitioner is directed to communicate this order to respondent no.2, District Magistrate, South 24Parganas. With the above observations, the writ petition being WPA 13080 of 2023 stands disposed of.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
