1. Heard learned Counsel for the parties.

2. The petitioner having admitted to have complied with 41A Cr.P.C. notice by the police, we are of the view that there is no need of custodial interrogation of the petitioner especially in view of the nature of transaction.

3. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, nature of transaction and the substantial progress in the investigation, it is directed that the petitioner shall be released on bail in the event of his arrest by the Arresting Officer on such terms and conditions as deemed just and proper in the facts and circumstances of the case in Connection with Malda Police Station Case No. 154 of 2023 dated 24.03.2023 including the condition that the petitioner shall not threaten, induce or coerce the victim in any manner whatsoever during the currency of the order.

4. Within 21 days of the receipt of server copy or certified copy of this order, the petitioner is directed to appear before the I.O along with a copy of this order.

5. Accordingly, the prayer for the anticipatory bail is allowed.
