The petitioner is aggrieved by the inordinate delay in disposal of the Title Suit No. 727 of 2021, pending before the learned Judge XIIIth Bench, City Civil Court at Calcutta. The petitioner prays that the hearing of the suit be expedited and the pending applications filed by both the parties be disposed of expeditiously.

It appears from records that the suit is proceeding ex parte and an application for acceptance of belated written statement is also pending.

The prayer of the petitioner is innocuous.

Neither party stands to lose if a proceeding is disposed of expeditiously. Hence, disposal of this revisional application does not require service of prior notice.

The revisional application is disposed of with a direction upon the learned court below to expedite

the disposal of the pending applications. The pending applications shall be taken up serially and disposed of by the learned court below within a period of three months from the next date fixed. Thereafter, the suit shall proceed expeditiously.

No unnecessary adjournments shall be given to either of the parties. This court has not expressed any opinion either on the merits of the pending applications or on the pending suit.

A copy of the revisional application along with a server copy of this order be served upon the opposite parities and/or their learned advocates contesting the matter in the learned court below, within a week.

The revisional application is accordingly disposed of.

There shall be no order as to costs.

Parties are to act on the server copy of this order.
